1. Acceptance of these Terms
These Terms of Use (“Terms”) are an agreement between you and Unitlyst LLC (“Unitlyst,” “we,” “us,” or “our”). By accessing or using Unitlyst, you agree to these Terms and our Privacy Policy.
If you do not agree, do not access or use the service.
2. The Unitlyst service
Unitlyst is property-management software for independent landlords and real estate investors. It helps users organize properties, units, tenant and lease information, rent-payment records, maintenance requests, and related reports.
Unitlyst is a recordkeeping and workflow tool. It is not a law firm, accounting service, payment processor, property manager, or financial adviser. Information shown in the service is not legal, tax, accounting, or financial advice.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use Unitlyst. You must provide accurate account information and keep it current.
You are responsible for safeguarding your sign-in credentials and for activity under your account. Notify us promptly at support@unitlyst.com if you suspect unauthorized access.
4. Early access and planned pricing
Unitlyst is currently offering a limited early-access beta. New eligible beta members receive a 14-day trial at no charge. Members who joined under an earlier offer retain their originally assigned beta end date. Beta features may change, be incomplete, or be unavailable from time to time.
Unitlyst currently plans to offer continued access after the beta for $10 per month. Payment processing is not active at this time. Before we charge you, we will present the applicable price, billing cycle, cancellation terms, and any refund terms, and we will obtain your express authorization and payment method. Merely creating an account does not authorize a charge.
5. Acceptable use
You may use Unitlyst only for lawful purposes. You may not:
- Use the service to violate another person’s rights or applicable law.
- Upload information you do not have authority to collect, use, or disclose.
- Attempt to access another user’s account or data.
- Interfere with, disrupt, probe, or bypass the service’s security.
- Copy, scrape, reverse engineer, or resell the service except as permitted by law.
- Transmit malware, fraudulent content, or unsolicited commercial messages.
6. Your data and responsibilities
You retain ownership of information you enter into Unitlyst. You grant Unitlyst a limited, non-exclusive license to host, process, transmit, and display that information only as needed to operate, secure, support, and improve the service.
You are responsible for the accuracy and legality of your information, including personal information about tenants, applicants, vendors, or other third parties. You represent that you have the notices, permissions, and lawful basis required to provide that information to Unitlyst.
7. Privacy
Our Privacy Policy explains how we collect, use, retain, and disclose personal information. By using Unitlyst, you acknowledge those practices.
8. Availability and changes
We may modify, suspend, or discontinue features, particularly during beta. We do not promise uninterrupted or error-free availability and do not offer a service-level agreement unless we agree to one separately in writing. We may perform maintenance, apply usage limits, or make changes needed for security, legal, or operational reasons.
9. Unitlyst intellectual property
Unitlyst and its software, design, text, graphics, trademarks, and other service materials are owned by Unitlyst LLC or its licensors. These Terms give you a limited, revocable, non-transferable right to use the service; they do not transfer ownership of Unitlyst intellectual property to you.
10. Third-party services
Unitlyst relies on third-party services, including Clerk for authentication and Replit for application hosting and PostgreSQL data storage. Your use of those features may also be subject to the providers’ terms and policies. We are not responsible for third-party services outside our control.
11. Suspension and termination
You may stop using Unitlyst at any time. You may request account or data deletion by emailing support@unitlyst.com.
We may suspend or terminate access if you materially violate these Terms, create a security or legal risk, fail to pay an amount you have expressly agreed to pay, or misuse the service. Where practical, we will provide notice and a reasonable opportunity to address the issue.
12. Disclaimers
To the fullest extent permitted by law, Unitlyst is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, title, non-infringement, or that the service will meet every legal or business requirement. You are responsible for reviewing records and maintaining any backups appropriate for your business.
13. Limitation of liability
To the fullest extent permitted by law, Unitlyst LLC and its members, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data.
Our aggregate liability arising from the service will not exceed the greater of $100 or the amount you paid Unitlyst during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
14. Governing law and disputes
These Terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in a court of competent jurisdiction in Texas, unless applicable law requires otherwise.
15. Changes and contact
We may update these Terms. If a change is material, we will provide reasonable notice through the service, by email, or by another appropriate method before the change takes effect. Continued use after the effective date means you accept the updated Terms.
